The defence argued that the alleged relationship continued over a long period, raising questions regarding consent, and contended that \u201cmisconception of fact\u201d cannot be presumed without clear and cogent evidence from the prosecution.<\/strong><br \/>\n<strong>The court observed that the prosecution must establish all essential ingredients of the offence and noted that no criminal history of the accused was presented.
