Bail Granted in Marriage-on-Promise Case by Fast Track Court-I, Varanasi

Varanasi, The Court of the Additional District and Sessions Judge / Special Judge (Fast Track Court-I), Varanasi, has granted bail to accused Anuj Rajbhar in a case registered under Sections 69, 351(2), and 352 of the Bharatiya Nyaya Sanhita (BNS), involving allegations of establishing a relationship on the false promise of marriage.
After examining the available evidence, prosecution submissions, and relevant Supreme Court precedents, the court passed a detailed and reasoned order allowing the bail application. The defence argued that the alleged relationship continued over a long period, raising questions regarding consent, and contended that “misconception of fact” cannot be presumed without clear and cogent evidence from the prosecution.
The court observed that the prosecution must establish all essential ingredients of the offence and noted that no criminal history of the accused was presented. Considering these factors, the court granted bail on a personal bond of ₹1 lakh with a surety of like amount.
The accused has been directed not to tamper with evidence, influence witnesses, or leave the country without prior permission of the court.
Legal experts view the order as reflecting a balanced judicial approach in bail matters, emphasizing that bail remains the rule while detention is an exception during trial.
